Sure, I bought the gun. I loaded it with live rounds. Yeah, I aimed it at the guy. I won’t deny I pulled the trigger, either. However, once the bullet left the barrel, I stopped being responsible for it! The bullet killed him, not me!
Really your responsibility ends when the hammer hits the back of the bullet casing. I mean you aren’t responsible for chemical reactions…
“Sure, we designed it, built it, taught it everything it knows, and are directing its actions, but holding us accountable for it is a bridge too far!”
Your honor, when I took off the parking brake, put the car in neutral, and gave it a big push down the hill, it was in the interest of science, to see how far it would go. I think a lot hinges on intent here. It certainly was not my intent to mow down five children at a bus stop.
His point is that without intent there shouldn’t be liability…
How could you even claim that as a lawyer. I wouldn’t be surprised if most liability is without intent.
It’s the only argument he’s got.
Putting aside the obvious “yes they should,” if they’re not liable when bad things happen, they also shouldn’t get any credit for good things.
How about: it is a hacking tool that has been used to commit cyber crimes. It should be confiscated and destroyed.
