    “The appointment of Attorney General James is improper,” the filing said. The petition accused James of having “unequivocally demonstrated a bias and presumption of guilt against the defendants named in the Civil Case, including Petitioner.”

    Isn’t presuming guilt what prosecutors are supposed to do?

      Well yes but actually no. That would only be appropriate after an investigation is complete and charges are filed. And prosecutors are pretty limited in what they’re allowed to say publicly even after that.

      I know Trump’s justice dept has screwed up a few prosecutions by making dumb public statements.

      Attacking James directly is a media strategy rather than a legal one I suspect.

        That would only be appropriate after an investigation is complete and charges are filed.

        But the investigation is only supposed to determine if there’s enough evidence to go to trial, right? So worst case, bias would just result in going to trial without a case and wasting the court’s time.

    She’s right to support the girl, obviously, but as a prosecutor she’s aware she has to keep those feelings private if there’s a chance she’s going to be prosecuting this case.

    Hold a gun to my head, she’s absolutely aware of that too, painfully aware after what she’s gone through previously. But as a public figure who may run for additional offices, she likely HAS to have a public opinion on this because people will demand it. It’s her opinion, but it’s performative for her potential constituency, if you catch my meaning.

    I bet she understands the tight rope she’s walking, and I bet she already knew making that statement would be a problem.
